Hickory Hollow House Rental Agreement

This Rental Agreement (“Agreement”) is made by and between Michele Aguila (“Owner”) and Guest. The individual executing this rental agreement (“Guest”) understands that they are doing so on behalf of all “Guest(s)” which means any and all individuals on the Property. By clicking "Request to book" the Guest is accepting all of the following terms and conditions:

Property: The property is described as a single-family dwelling with 3 bedrooms and 3 bathrooms located at 1027 County Road 619, Newton, NJ 07860 (“Property”). The Property is owned by Owner.

Occupancy: Guest(s) understands and agrees that a maximum of 8 (eight) guests are permitted to stay at the Property. Violation of these terms shall give Owner the right to immediately evict Guest(s) and terminate this Agreement, and Guest(s) will forfeit any right of return of any monies paid to date.

Parking. Guest(s) parking is available on the gravel driveway except directly in front of the garage. Please do not block access to the garage doors. Garage is not accessible to Guest(s).

Security Cameras. Security cameras are solely for monitoring outside the property and are not present inside the property. Guest(s) acknowledges that security cameras are used to ensure the security of the premises from theft, unauthorized access, or damage to the property. Guest(s) agrees not to tamper with the security cameras.

Cancellation Policy. 90% of paid prepayments will be refunded if Guest(s) cancels 60 days before arrival or earlier. 0% refundable if canceled after.

Rental Rules & Restrictions. Guest(s) agrees to abide by the following restrictions by Owner:

  • No pets
  • No smoking or vaping
  • Living Room fireplace is not for Guest(s) use
  • No parties, events, or gatherings
  • Individual executing this agreement must be 25 years or older
  • Quiet Policy: Please note that the dwelling is located in a very peaceful neighborhood. Parties, loud noise and unruly behavior are absolutely prohibited. All Guests are expected to respect the neighbors and tranquility this lake community affords.

* Please note: Owner/Host resides next door to this Property. If Guest(s) fails to abide by any of the Rules & Restrictions and/or Maximum Occupancy, the Guest(s) may be asked to vacate the Property and Guest(s) will forfeit all rent paid.

Security Deposit. Owner reserves the right, at its discretion, to charge a security deposit at the time of the reservation. This deposit will be refunded after Guest’s departure and an inspection of the Property by Owner, less any deductions for damage to the Property or furnishings, excessive mess requiring additional cleaning or other costs incurred outside the normal course due to Guest’s stay.

Cleaning Fee. A cleaning fee will be charged to the Guest(s). Daily housekeeping services are not included. Throughout the rental period, Guest(s) will be responsible for keeping the Property clean and in good condition. Any unsafe or dangerous condition must be reported to Owner immediately. Guest(s) acknowledges that on the Arrival Date, the Property is in good condition, except for any defect Guest(s) may report to Owner by end of the Arrival Date. The Property should be left in the same condition as it was found by Guest(s) on the Arrival Date. Guest(s) promises to leave the Property in good repair.

Mechanical Failures. Owner attempts to properly maintain the Property. While all electrical and mechanical equipment within the Property is in good working order, Owner cannot guarantee against mechanical failure of electrical service, stopped plumbing, water supply, heating, air-conditioning, audio-visual equipment, internet access, or appliances. Guest(s) agrees to report any inoperative equipment or other maintenance problem to Owner immediately. Owner will make every reasonable effort to have repairs done quickly and efficiently. Guest(s) will allow Owner or a person permitted by Owner access to the Property for purposes of repair and inspection. Owner is not responsible for any inconvenience that may occur and no refunds or rent reductions will be made due to failure of such items.

Acts of God. If there is a storm or severe weather and a mandatory evacuation order is issued by state or local authorities, Guest(s) shall be entitled to a prorated refund for each night Guest is unable to occupy the Property. Owner will not be liable or deemed in default under this Agreement for any failure to perform or delay in performing any of its obligations due to or arising out of any act not within its control, including, without limitation, acts of God.

Kayak/Paddling Policy. When borrowing kayaks/paddle boards, Guest(s) is accepting 100 percent of the inherent risks of this low-risk activity. Guest(s) is also stating that you are comfortable kayaking/paddling and can swim well. Guest(s) acknowledges a strong understanding of water safety. And Guest(s) has the ability to re-enter a kayak/paddle board on their own. Guest(s) will use a life vest at all times. Guest(s) agrees to use these boats at their own risk.

Outdoor Fire Pit Policy. The Owner provides an outdoor fire pit for Guest(s) enjoyment. Guest(s) agrees to be cautious when building fires in the fire pit and to burn only the materials provided. Guest(s) agrees to contain the fire within the fire pit at all times and never beyond, and further agree to never leave the fire unattended.

Wildlife. The Property is located in rural New Jersey and therefore is home to many species of insects and other types of wildlife. Guest(s) is not permitted to approach, touch or feed any wildlife on the property. Guest(s) assumes all risks from any wildlife on the property, including insects, bears, turtles, snakes, coyotes, raccoons, etc. All food should be stored either in the refrigerator or in sealed packages or containers. Be sure to clean up all areas where food is prepared and served, clean up spills and crumbs from snack foods immediately, and do not leave dirty dishes lying around the premises. The Owner will not relocate Guest(s) or issue refunds or discounts due to insect or wildlife sightings.

No Assignment, Subletting or Visitors. This Agreement shall not be assigned, nor the premises sublet without the prior written consent of the Owner. Guest(s) acknowledges that they will personally occupy the property for the entire lease or rental period and will not sublet any portion of the property during their stay. Daytime visitors of guests are prohibited without prior written consent from the Owner. Overnight visitors of guests are strictly prohibited. Violation of these terms shall give Owner the right to immediately evict Guest(s) and terminate this Agreement, and Guest(s) will forfeit any right of return of any monies paid to date.

Limitation on Liability. Owner is not responsible for any accidents, injuries or illness that occur to any Guest(s) while in the Property or on the Property. Owner is not responsible for loss of personal belongings or valuables belonging to any Guest(s). Guest(s) agrees to assume the risk of any harm arising from use of the Property. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, INCLUDING TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL OWNER BE LIABLE TO GUEST(S) OR ANY OTHER PERSON FOR ANY DAMAGES OF ANY NATURE WHATSOEVER INCLUDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR GUEST’S RENTAL OF THE PROPERTY OR USE OF THE PROPERTY. IN NO EVENT WILL OWNER BE LIABLE FOR ANY DAMAGES IN CONNECTION WITH THIS AGREEMENT, EVEN IF OWNER SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

Indemnification. Guest(s) acknowledges that the use of the Property is entirely at their own risk. Guest(a) will indemnify and hold harmless Owner from any and all expenses, costs, damages, suits, actions, or liabilities whatsoever arising from or related to any and all loss of or damage to personal property, including injury or death resulting from the use or occupancy of the Property or the failure of any Guest(s) to observe the rules and restrictions set forth in this Agreement.

Violation of Agreement. If Guest(s) violates any of the terms of this Agreement, including but not limited to maximum occupancy, rental rules and restrictions, Owner may evict Guest(s) from the Property and Guest(s) will forfeit all rent and security deposit paid.

Governing Law. This Agreement shall be governed by the construed in accordance with the laws of the State of New Jersey. In the event of a dispute, all parties agree that any legal action shall be maintained in Sussex County, New Jersey. All parties consent to Sussex County, New Jersey jurisdiction.

Amendments. This Agreement may be amended or modified only by a written agreement signed by both Owner and Guest(s).

No Waiver. Neither Owner nor Guest(s) shall be deemed to have waived any provision of this Agreement or the exercise of any rights held under this Agreement unless such waiver is made expressly and in writing.

Severability. If any provision of this Agreement is held to be invalid or unenforceable in whole or in part, the remaining provisions shall not be affected and shall continue to be valid and enforceable as though the invalid or unenforceable parts had not been included on this Agreement.

Notices. Any notice or communication under this Agreement must be in writing and sent via email or postal mail.

Entire Agreement. This Agreement represents the entire understanding and agreement between the Parties with respect to the subject matter of this Agreement and supersedes all other negotiations, understandings and representations (if any) made by and between the Parties.

AGREEMENT: By booking this rental, Guest(s) covenants and agrees that (s)he has read and understands the foregoing Agreement, including the indemnification and limit on liability agreement, and has shared such information with and any all Guest(s) on the property. Guest(s) understands that by checking the applicable box hereto, (s)he is entering into this Agreement, agrees to the terms and conditions of the Agreement, and (s)he is waiving valuable legal rights on behalf of him/herself and any and all Guests of the Property. Guest(s) agrees that by checking the box indicating acceptance of the rental agreement, that such binds all Guest(s) and has the same enforceability and admissibility as a handwritten signature, and shall be fully admissible in any legal proceeding.
